Terms and Conditions

Terms and Conditions for Commissions & Workshops


1. Definitions

  • Client: The individual or entity engaging the services of Imagine Ink for art commissions, workshops, or related activities.
  • Deposit: A non-refundable payment made by the Client to initiate the commission or reservation for services.
  • Balance: The remaining amount due after the Deposit has been paid, payable by the specified due date.

2. Payment Terms

  • Accepted payment methods for both deposits and balances include cash, bank transfer, PayPal, AfterPay, and ApplePay, GooglePay, Square EFTPOS.
  • The Deposit is required immediately upon agreement to commence work.
  • The Balance is due by the specified due date in the invoice.
  • Any or all commissioned artwork still not paid in full two  (2) calendar months after the due date will be destroyed, donated or sold without further notice.   

3. Interest Rate for Late Payments

  • An interest rate of 10% of the outstanding balance will be charged per week (every 7 days) until the full payment is received.

4. Non-Payment Consequences

  • In the event of non-payment, future services may be refused.

5. Initial Sketch and Amendments

  • A consultation will be held either in person or by phone. Clients may send reference images for inspiration.
  • After discussions, a rough paper sketch will be created, and a quote will be provided detailing canvas size, style, preparation work, and estimated time for completion.
  • Once the client agrees to the quote, an invoice will be issued for the Deposit and Balance.
  • After sketching the canvas, a photo will be sent for approval of subject placement, which cannot be altered once painting has commenced.
  • A progress photo will be provided midway through the project. Only minor amendments to colour choices and detailing can be made at this stage.
  • Major amendments such as restarts, subject repositioning, additional major details, or changes to canvas size and style may incur a new invoice. All amendments must be confirmed in writing via email or SMS.

6. Communication

  • Clients may contact by phone (text) but must confirm all requests in writing.

7. Security Deposit

  • All deposits are non-refundable and cover costs related to research, travel, and art preparation, including canvas and paint.

8. Consumer Protection

  • Deposits for art workshops are non-refundable. Balances paid are refundable up to 48 hours prior to the event. Balances can be transferred to another date upon client request.

9. Transferability of Deposits

  • Deposits can be transferred within 2 months of the original date if the new date is available.

10. Clarification of Services

  • Imagine Ink reserves the right to cancel any event due to illness or personal circumstances, providing a full refund within 48 hours of cancellation.

11. Client's Responsibilities

  • Clients are expected to communicate effectively regarding changes, cancellations, or any other inquiries. All significant communications should be documented as outlined in the communication section.

12. Liability

  • Imagine Ink will not be held liable for any damages or losses incurred as a result of cancellations or changes initiated by the client or unforeseen circumstances affecting service delivery.


Painting Workshops

Payment Terms

  • A non-refundable deposit is required to secure your booking date and time. The remaining balance is due no later than the date specified on the invoice.
  •   Payment of the deposit is confirmation that you have read and accepted the Terms and Conditions of hiring Imagine Ink Gold Coast.
  • Payments can be made via Cash, bank deposit, Square EFTPOS, ApplePay, AfterPay or PayPal. 
  • Failure to complete payment by the due date may result in the cancellation of your booking.  A cancellation email will confirm the withdrawal of your booking and no correspondence with be entered into. 


What Imagine Ink Provides

Imagine Ink is committed to creating a memorable painting experience. We will provide the following:

  • Mobile Service: Our team will bring the workshop directly to your location.
  • Art Supplies: All necessary paints, canvases, aprons, brushes, easels, and table covers will be supplied.
  • Clean-Up: We ensure a thorough clean-up after the event so you can enjoy the experience without worries.
  • Custom Inspiration Artwork: Tailored artwork ideas will be provided to inspire your guests.
  • Models (if applicable): Professional models will be available to assist with the painting process.
  • Step-by-Step Tuition: Our expert instructors will guide participants through a 2-3 hour painting session, ensuring an enjoyable and educational experience.


Client Responsibilities

To ensure a flawless workshop experience, the booking client is responsible for providing the following:

  • Tables and Chairs: Adequate seating for each guest.
  • Access to Water: Refreshments for participants during the workshop.
  • Food and Beverages: Any catering requirements for the event.


Host Arrival and Setup

  • The workshop host will arrive approximately 1 hour prior to the event start time. It is imperative that access is granted for setup, which includes arranging tables, chairs, and preparing painting stations.


Cancellation and Safety

  • The host reserves the right to cancel the event at any time if they feel unsafe or if the workshop becomes unmanageable due to guest behaviour. In such cases, no refunds will be issued. The safety and well-being of our staff is our utmost priority.


Damages

  • The booking client will be invoiced for any damages caused by themselves or their guests during the event. In situations where damages are significant, the police may be notified as necessary.


Invoice and Guest Policy Clause

The pricing quoted for the painting workshop is based on various factors including but not limited to the type of event (e.g., fundraiser, adult, children), the duration of the workshop, the minimum number of guests required, the level of social media cross-promotion necessary, the preparation of promotional materials, donated gifts and prizes, and travel distance.

Upon acceptance of the quote and receipt of a deposit, the client agrees that the number of guests cannot be reduced, and therefore the invoice amount cannot be decreased based on a lower guest count. The client may, however, increase the number of guests, which will result in an adjusted invoice reflecting the total cost based on the new guest count.

Any changes to the number of guests must be communicated no later than 5 days prior to the event, to ensure proper preparation and resource allocation.
